Wills
A Will is used to ensure that assets that you wish to give to particular persons after your death, such as stocks & shares, a motor car, jewellery or a picture, are in fact given to them.
In order to make a Will, you must be of "sound mind, memory and understanding" and aged over 18. Your Will must be signed by you in the presence of two people who not only see you sign, but who also see each other sign at the same time. There are therefore three signatures on each valid Will, namely your own and those of your two witnesses. The witnesses must also be aged over 18 and must not be a beneficiary or otherwise they will be prevented from collecting whatever you wish to give them. This is to avoid what is called "undue influence" - i.e. that you were persuaded to make certain gifts to particular persons when you might not otherwise have done so.
Your Will should have a clause revoking all previous Wills (so that there is no conflict between Wills) and will appoint persons who are to carry out your wishes after your death. These persons are known as Executors. You should consult the people who you want to appoint as your Executors before making your Will so that they know what to expect later, and the duties they will have to undertake.
